What To Do After Receiving an Amazon Intellectual Property Complaint

An Amazon infringement complaint can interrupt sales immediately, but a hurried response can create additional problems. The first priority is to preserve the notice, identify the alleged right and understand what Amazon is requesting.

Identify the actual allegation

Record the complaint ID, affected ASINs, rights-owner details, cited registration or patent and the date of the notice. Trademark, copyright, design-patent and utility-patent complaints involve different legal questions. Do not assume that a generic statement of originality answers every complaint.

Preserve and organize evidence

Keep screenshots of the listing and product packaging, supplier records, licenses, technical drawings and prior communications. Preserve historical versions of the listing before making corrections, where appropriate. Avoid altering documents or preparing unsupported explanations.

Assess the right response

A rights-owner retraction request, evidence of authorization, substantive non-infringement analysis or correction of listing content may be appropriate in different circumstances. Repeating a rejected appeal without resolving its weaknesses may not help. A submission should address the precise reason given and be consistent with other communications.

Additional considerations

Before responding, distinguish the rights-owner allegation from any separate account-health or product-compliance concern. The information required for a patent complaint may differ substantially from what is relevant to a trademark or copyright allegation. Confirm which products and marketplaces are actually covered by the notice.

A useful case file includes a dated timeline, the current and previous listing text, complaint identifiers, registered-right records, product comparisons and all Amazon responses. If a seller contacts the rights owner, the request should be supported by accurate facts rather than an unsupported promise of non-infringement.
